בהתאם לקוח 30 א׳ לקוח ההתקשרות (בזק ושירותיו) תשמ״ב 1982 - הלקוח יודגר מפרסם כהגדרתו בתיקון מס׳ 63 תשע״ו 2016.החברה לא תשא באחריות בגין תביעות על פי חוק זה, וכן הלקוח תחייב לשפות את החברה בגין כל נזק העלול להיגרם כתוצאה מהפרה.
על הלקוח לספק חשבונות פרסום פעילים ומאושרים, ללא היסטוריית חסימות מטעם פלטפורמות הפרסום.
החברה לא תשא באחריות בגין כל מעשה או פעולה עליה אחראיות החברות: פייסבוק, גוגל, טאבולה, אווטבריין, שלח מסר, אינסטגרם, טיקטוק וכו׳, לרבות דרכי וזמני גביית תשלום בגין פרסום, הגבלת שירות, הגבלת חשבון, חסימות ומחיקות. בתקופה זו כל פעולה של יצירת קשר וניסיונות לעזור ללקוח אל מול חברות אלו, יכללו כימי עבודה לכל דבר ועניין והלקוח יחוייב בהתאם. הלקוח מודע לסיכונים בגין פרסום אורגני וממומן (לרבות שימוש ברובוטים) ומאשר כי הוא האחראי הבלעדי לכל טענה בגין סעיף זה.
הלקוח מאשר כי החברה מורשת לבצע פעולות בחשבונות ובפרופילים ברשתות החברתיות כגון - העלאת קמפיינים, שינוי שם חשבון מודעות, פרסום בדפים, ביצוע עוקב והסרת העוקב אחרי קהל היעד המוגדר לנו מראש, ביצוע לייקים ותגובות (לפוסטים של משתמשים אחרים), וכו׳.
הלקוח מתחייב שלא לפגוע במוניטין החברה באמצאות פרסומים ברשתות החברתיות ובגוגל, ו/או בכל אמצעי פרסום אחר. במידה ויעשה כן, החברה שומרת לעצמה את זכותה להגשת תביעה בגין הפרת חוק איסור לשון הרע תשכ״ח 1965.
בעת הצטרפות הלקוח לשירותי החברה, הלקוח מאשר הסכמתו המפורשת לקבל דבר פרסומת מהחברה, וכי החברה רשאית לפנות ללקוחותיה באמצעות דיוור ישיר, לרבות בדואר אלקטרוני וכן באמצעות הודעות סמס ו/או פנייה טלפונית למטרות שיווק וכיוצ״ב. ללקוח לא תהיה כל טענה כנגד החברה ו/או מי מטעמה בעניין זה.
החברה רשאית למסור את הפרטים האישיים של הלקוחות לכל אחד מהעובדים, המנהלים, המבטחים, היועצים המקצועיים, הסוכנים, הספקים, או קבלני המשנה, במידה סבירה וכנדרש על פי חוק. החברה לא תעביר את פרטי הלקוח לגורמי צד ג׳ ללא אישור הלקוח.
על תקנון זה יחולו דיני מדינת ישראל. כל סכסוך הנוגע לתקנון יהיה בסמכות הבלעדית של בית-המשפט המוסמך במחוז תל-אביב.
